Official Rules

NO PURCHASE REQUIRED TO ENTER OR WIN. OPEN TO LEGAL RESIDENTS OF 50 U.S. AND D.C.

1.  Eligibility:
San Antonio Getaway Package– Register to Win is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees, officers and representatives of Houston Street Development Corporation, Federal Realty Investment Trust, Reata Property Management, Inc, The MightyGroup, all Participating Partners and their respective subsidiaries, and the immediate family (spouse, parents, siblings, and children) and household members of each are not eligible. Register to Win is subject to all applicable federal, state, local laws and regulations..

4.  Agreement to Official Rules:
By participating in the Register to Win, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding in all matters related to the Register to Win.

5. Timing:
The Register to Win will begin April 10, 2009 at 12:00 a.m. Eastern Time ("ET"), through 11:59 p.m. ET, June 13, 2009 (the "Register to Win Period"). Administrator’s computer is the official time keeping device for this Register to Win.

a. How to Enter the Register to Win: 1) Go directly to Hstreetsa’s web site at www.hstreetsa.com, locate and click on "Register to Win" icon/button, provide all information requested including your name, address, zip code, and date of birth, and click on the "Register Me To Win" button; you will then automatically be entered in the Register to Win.

6. Each entrant may enter the Register to Win only one (1) time during the Register to Win Period, regardless of the method of entry. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's plays/entries and that entrant may be disqualified. All entries must be received during the Register to Win Period. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.  No mechanical reproduction of entries allowed.  Entries become property of Sponsor and will not be returned.

7. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR OR ADMINISTRATOR, WHOSE DECISIONS ARE FINAL.   AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE REGISTER TO WIN SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.


8. Method of Determining Winner:
The grand prize winner will be selected in a random drawing of all entries received on or about September 1, 2009 at The MightyGroup, 1617 E. Commerce San Antonio, Texas 78205. Winner will be notified by email or by registered letter sent to the address listed on the entry. An entrant need not be present to win. Houston Street Development Corporation’s decisions are final in binding in all respects.

9. Verification of Winner:
The selected winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Except where prohibited, the Grand Prize winner (and his/her parent/legal guardian sign if winner is an eligible minor in
his/her state of residence) must sign and return, within ten (10) days of being notified, an Affidavit of Eligibility Liability and Publicity Release in order to claim his/her prize. If any potential winner cannot be contacted, fails to sign and return the Affidavit of Eligibility, Liability and Publicity Release within the required time period (if applicable), or prize notification is returned as undeliverable potential winner forfeits prize. An alternate winner will be selected in his/her place in a random drawing from among all eligible entries received. 

10. Prizes:    
Register to Win: ONE (1) WEEKEND GETAWAY PACKAGE IN SAN ANTONIO:The winner and one guest (two people total) will win a two-night stay in a deluxe guestroom at the Hotel Valencia Riverwalk. The trip includes two nights’ accommodations in the Hotel Valencia Riverwalk only. All other expenses not specifically mentioned herein are solely the Prize winner’s responsibility. Other prizes have certain restrictions.

Accommodations are subject to availability and must be taken before May 1, 2010 or prize will be forfeited. Redemption is based on space availability and blackout dates may apply. The certificate is provided complimentary by the Hotel and has no cash value. Certificate must be presented at time of service. The certificate once delivered to the winner cannot be replaced if lost or stolen. Winners and guests must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license, passport) required for travel. Incidental expenses such as phone calls, transfers to/from resort, meals not provided, and any other expenses not mentioned here is the sole responsibility of the winner.

For all prizes: Winner is solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use. No substitution, assignment or transfer of prizes permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value. Grand Prize has no cash value.

11. Publicity:
Except where prohibited, participation in the Register to Win constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media, without further payment or consideration.

12. General Conditions:
Sponsor reserves the right to cancel or modify the Register to Win if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Register to Win, as determined by Sponsor in its sole discretion. In such event, Sponsor reserve the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Register to Win or to be acting in violation of these Official Rules or any other Register to Win, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Register to Win is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and costs (including without limitation attorneys' fees) from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

13. Release:
By receipt of any prize, winner agrees to release and hold harmless, Houston Street Development Corporation, Federal Realty Investment Trust, Reata Property Management, Inc, The MightyGroup, all Participating Partners and their respective subsidiaries, its officers, directors, members, employees, and agents (“Released Parties”), from and against any claim or cause of action arising out of participation or attempt to participate in the Register to Win or receipt or use of any prize.

14. Limitations of Liability:
Released Parties are not responsible for, and entrants release and hold the Released Parties harmless for:
(i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software;
(ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service;
(iii) unauthorized human intervention in any part of the entry process or the Register to Win;
(iv) electronic or human error which may occur in the administration of the Register to Win or the processing of entries; or
(v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which injury or damage may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Register to Win.

15. Disputes:
 Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Register to Win, or any prizes awarded, shall be resolved individually, without resort to any form of class action. Any and all claims, judgments and awards shall be
limited to actual out-of-pocket costs incurred, including costs associated with entering this Register to Win, but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

16. Entrant's Personal Information:
Information collected from entrants is subject to the Sponsor's Privacy Policies.

17.  Winners List:
For the name of the winners, available after September 1, 2009, send a separate stamped, self-addressed #10 envelope before November 15, 2009 to: San Antonio Weekend Getaway, Spring 2009, C/O Houston Street Development Corporation, 219 E. Houston Street, Suite 250, San Antonio, Texas 78205.
